Therm Reservation - Thank you for placing a presales reservation for a Therm Smart Radiator Thermostat. By making your Reservation, you have secured the approximate priority within your region for taking delivery of your Therm device.
Cancellable by Therm - Therm may cancel this presales reservation for any reason at any time before your device ships.
Effective Date - Your Reservation becomes effective when you place your Reservation.
Order Process - While this Reservation secures the approximate delivery priority, it does not constitute the purchase or order of a Therm device. When the start of production for your Reservation nears, we will process your saved credit card. Therm will create an order for your device and you will receive a receipt indicating the purchase price of the device, plus any applicable taxes. The device will ship to the address on file which may be updated by reaching out to
experience@hellotherm.com. Until your device ships, your Reservation may be cancelled at any time.
Acknowledgements; Non-Transferable - You understand that we will place a 7 day hold on your card upon Reservation, but not charge your card until the device is ready to ship. Your Reservation is not transferable or assignable to another party without the prior written approval of Therm.
Payment Terms - This Agreement is subject to Therm's payment terms which are available at
hellotherm.com/terms.
Your Details - From time to time we will ask you to provide information so that we can perform our obligations under these terms and conditions. We will maintain your personal information in accordance with our Privacy Policy, which is available at
hellotherm.com/privacy. Limitation of Liability.
No Indirect Damages. IN NO EVENT SHALL THERM (OR ITS SUPPLIERS OR LICENSORS) BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, MULTIPLE OR OTHER INDIRECT DAMAGES, OR FOR LOSS OF PROFITS, LOSS OF DATA OR LOSS OF USE DAMAGES, ARISING OUT OF THE PRODUCTS OR THERM APP, MANUFACTURE, PRESALE, SALE, SUPPLYING OR FAILURE OR DELAY IN SUPPLYING OF THE PRODUCTS, SERVICES RELATED THERETO OR THE USE, RESULTS OR DISPOSITION OF THE PRODUCTS, WHETHER BASED UPON WARRANTY, CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF SELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.
Limited Direct Damages. THERM (AND ITS SUPPLIERS’ AND LICENSORS’) LIABILITY ARISING OUT OF PRODUCTS AND THE THERM APP, THE MANUFACTURE, PRESALE, SALE, SUPPLYING OR FAILURE OR DELAY IN SUPPLYING OF THE PRODUCTS, SERVICES RELATED THERETO OR THE USE, RESULTS OR DISPOSITION OF THE PRODUCTS, WHETHER BASED UPON WARRANTY, CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, SHALL NOT EXCEED THE APPLICABLE PURCHASE PRICE PAID BY CUSTOMER FOR THE APPLICABLE PRODUCT OR SERVICE IN THE THEN-PRIOR TWELVE (12) MONTHS.
